This EU regulation is set to increase user privacy and punish companies that neglect personal data safety. In this video I'll give you a summary of GDPR and the main points that might interest you as a company or private person. In GDPR will be big topic for companies as this will require some changes to the websites so that they comply to the new regulation. It will take an effect on 25 May 2018. It will impact your company if you handle any data from EU citizen. So no matter where your company is based, if you collect data from EU citizens this will apply to you. Now to consumers this is not that bad of a deal. This regulation gives power back to the people. As EU sees privacy as human right. Now for companies this means that they need to look into their process and infrastructure. Analyze what is collected, where is it collected and how the data is used and how it is secured. This will give transparency to consumers, as we will know what is collected and why. There is also small benefits to companies as this will be one regulation across whole europe and not per country, as it is now. Tracking is still allowed but you have to make sure it's done the right way. You need to get user's explicit consent in simple language and ability to opt out at any time. What might be challenging is that current data has to oblige to the new regulation. So you need to make sure that old data has user's consent. I think this regulation will be taken seriously as penalties are severe. At most, 20 million dollars or 4% of global turnover (whichever is higher). There is no one entity that will monitor this regulation, however if you get too many complaints from consumers, you might get sued. There are 7 key rights that GDPR emphasizes: 1. User consent to tracking and ability to opt out 2. Data breach notification within 72h after breach 3. Rights to access your own data 4. Right to be forgotten, so at any point you can ask the company to permanently delete your data 5. Data portability, you have the right to reuse the data elsewhere 6. Privacy by design, companies do out most to secure personal data 7. Data protection officer needs to be appointed if you are companie with 250+ employees

The new law allows European regulators to fine companies for collecting or using personal data without users' consent. Facebook is liable under GDPR fines of up to 4 percent of its global revenue, around $1.6 billion, for any infractions, according to the Guardian. In this video, you will learn about GDPR, the European Union’s, General Data Protection Regulation which comes into force on May 25, 2018. The GDPR replaces the 1995 Data Protection Directive. It was approved and adopted by the EU Parliament in April 2016. One of the main goals of the GDPR is to give individuals in the European Union more control and flexibility on how their data is used and processed. It also puts the responsibility on businesses and individuals who process information from these EU individuals. Some of the Key GDPR Requirements include: (1) Consent to use personal data; (2) Privacy by Design; (3) Right to Data Access; (4) Right To Be Forgotten; (5) Data Portability; (6) Data Rectification; (7) Data Breach Notification. I will be covering these GDPR Regulations in more detail, in a separate video (see link below). That being said, it’s important that you know if and how GDPR affects you. For example, if you own a website and even have a Contact form, use cookies on your site, use Google Analytics to track visitor, and the like, you are mostly like affected by GDPR and need to take appropriate action to remain in compliance. On 6 October 2015, the ruling of the European Court of Justice (ECJ) likewise an earthquake sent ripples through the global privacy community. In consequence, even the validity of the remaining vehicles for the legitimisation of personal data transfers to countries outside the EU / the EEA, i.e., EU Model Clauses and Binding Corporate Rules, are subject to review of the national data protection agencies and the Art. 29 Working Party. Further, at the beginning of 2016, the EU Data Protection Directive of 1995 shall be replaced by the new EU General Data Protection Regulation. This Regulation will incorporate a unitary privacy regime within the whole EU. This law on privacy and data protection will have consequences for any business handling personal data of EU subjects. So, what should a webmaster do to avoid legal penalties? Joerg Gastmann emailed us his question on the GDPR: 'At YoastCon 2017, Dixon Jones mentioned that certain plugins collect data about users and this might cause problems with the EU General Data Protection Regulation (GDPR). Preparing for the GDPR: “Well, you don’t get a penalty specifically for the fact that these plugins are using that data. You get a penalty for not getting your user’s consent for doing that. So you should get your user’s consent, or stop doing that. Some of these things you can put into your general terms of service because they’re required for your business to work. But if you’re doing things like profiling people based on what they visited, based on information they’ve given you them about them, then you should really dive into the GDPR. This is not something I can easily answer in a couple of minutes. It’s a lot of work. There are a lot of people that are very hard at work, making sure that we can do all the things in WordPress that you should be able to do under the GDPR. So yeah, dive in, consult a lawyer- I’m not a lawyer. Good luck!”

Setting the Agenda for Information Security in Europe by Bob Tarzey, Analyst and Director, Quocirca For better or for worse, Quocirca believes the most important Security Change Agent effecting IT decision making in Europe is the EU Data Protection Directive. It affects not just people and business within the EU, but those living beyond its boundaries that transact with the world’s largest single trading block. The legislation is passed down by the European Commission with its president and 28 commissioners representing each of the member states. The Commission first passed the Directive in 1995 in response to the growing use of the internet. It incorporates the seven principles for the protection of personal data first laid out by the OECD (Organization for Economic Cooperation and Development) in 1980. It provides guidance on the storage, movement and processing of personal data regarding European citizens. As a directive it is not mandatory but many aspects of it have entered the laws of individual countries. At its core is the principle that the processing of personal data should be transparent, legitimate and proportional. For example, a bank should not collect data about a person’s religion if all it is doing is providing a loan and the individual should know what data is being collected and that the data will be adequately protected. In 2012 a process was put in place to upgrade the directive to a regulation, an on-going process that may take years. When this completes it will be mandatory rather than optional for member states. As well as strengthening core principles, especially those around disclosure, the regulation will significantly increase the fines applicable to a business that breaches the rules. Furthermore, the rules are being reinforced all the time through the courts, such as the 2014 ruling by EU Court against Google confirming the “right to be forgotten”. So why is dry-sounding legislation the most important Security Change Agent to come out of Europe? It is less the directive itself, but the debate it inspires. No security vendor’s presentation is complete without warnings about the EU DP law and how the vendor can help prospective customers comply. No return on investment calculation, however flawed, is complete without adding on the cost of potential fines that are helpfully set to increase. And it is not just security vendors; a key tenet of the law is that European citizens’ data must be stored within the EU unless safe harbour agreements are in place. This has forced every cloud-based service provider to think about the way it plans infrastructure investment and trades in the EU. More than any black-hat or security guru, EU DP law is setting the agenda for information security in Europe and for those that wash up on its shores.

What is GDPR? GDPR (General Data Protection Regulation) is a new legislation that applies to all companies who collect, store and process any data belonging to EU citizens. GDPR applies to all companies across the world who work with EU citizens. It doesn’t matter where you are located in the world, if you’re dealing with EU citizens, you need to comply with GDPR. Why has it been introduced? The main reason for the introduction of GDPR is to provide people with more control over their personal data. GDPR goes into effect on May 25, 2018. Its main purpose is to focus and alter the way in which businesses are acquiring, storing and managing people’s private information. What is the risk of non-compliance? The GDPR has real teeth to it. Penalties and fines can be as high as 4% of annual revenue or €20 million, whichever is greater. What are the rights under GDPR? Under GDPR, consumers enjoy a variety of new privacy rights regarding their personal data. Enterprise needs to create a channel for visitors or customers to submit any right requests, and an attendant process to fulfil them. What are the key features of GDPR? Right of Access: It gives citizens the right to access their personal data about how this information is being processed. A data controller must provide, upon request, a copy of the actual data. Right to be Forgotten: A person has the right to request erasure of personal data related to him/her. Right to Rectification: A person can ask you to correct any inaccurate personal data you’re holding about him or her. Right to Data Portability: A person can receive any personal data he or she has provided to your organization, which that individual can then pass to another enterprise without hindrance from you. Right to Object: The visitor/consumer can object to you processing their personal data, unless you can demonstrate good reasons for doing so that override the person’s interests. What are the lawful rights for Companies? Data Consent: The visitor/consumer has to give consent for processing of their personal data. The typical “calls are recorded for training and security purposes” warnings will no longer applicable without getting consent. Data breaches: In case of any data breach, a company is under a legal obligation to notify the supervisory authority without undue delay. There is a maximum of 72 hours after becoming aware of the data breach to make the report. Individuals have to be notified if adverse impact is determined. Data protection officer: Companies have to appoint a Data protection officer in order to be GDPR compliant. The DPO is similar to a compliance officer and is expected to be proficient at managing IT process, data security and other critical business continuity issues dealing personal and sensitive data. It’s no surprise that managing compliance with the transparency and consent requirement of the GDPR presents a daunting undertaking. Yet companies need to become compliant quickly. How to get there, especially when it comes to obtaining consumer consent, is a question many seem to be saving for the last minute. General Data Protection Regulation: What Do the New EU Rules Mean for Libraries
