In general, the form you must use to file your business taxes is determined by the type of business you have organized. Some business owners choose an LLC that has a lot of flexibility when it comes to filing taxes. They can be taxed like a sole proprietor, partnership, or even like a corporation. If you are the only member of your LLC, then you will be automatically treated like a sole proprietor. Most multiple member LLCs will be treated like a partnership. If you intend to be classified as an S Corporation, you need to complete Form 2553. If you are organized as a C Corporation or S Corporation, you should file a Form 1120 or Form 1120S, respectively. When you are running a small business, you may not have enough resources to maintain proper accounting information and calculate your profit or loss. This makes it difficult to keep track of your income from such a business and find out how much tax you need to pay. With this in mind the Income Tax Department has laid out some simple provisions where your income is assumed based on the gross receipts of your business. This method is called the presumptive method, where tax is paid on an estimated basis. From FY 2016-17 onwards, if gross receipts are received through digital mode of payments ,then Net Income is estimated at 6% of such gross receipts and for cash receipts ,rate is same at 8% of such cash receipts. You don’t have to maintain books of accounts of this business. Eligibility Criteria for this Scheme To be eligible for this scheme: Your gross receipts or turnover of the business for which you want to avail this scheme should be less than Rs 2 crore. You must be a Resident in India. This scheme is allowed to an individual, a HUF or a partnership firm. It is not available to a Company. The taxpayer can voluntarily declare a higher income and pay tax on it. In case the taxpayer chooses to declare lower income than 8% of gross receipts – he shall have to maintain books of accounts and get them audited. Small Business Tax Tips to Maximize Your Tax Return: http://andrewshin.net As millions of small business owners get ready to file their taxes, they will be searching for exemptions that might be possible for their business. Luckily, there are many exemptions and credits that owners can take advantage of. By writing off certain expenses, a business owner can significantly reduce their tax burden and put the extra money towards growing their enterprise. First off, you must understand the difference between a credit and a write off. A credit is a dollar for dollar deduction from your taxable income. An exemption will qualify for only a percentage. Following is some useful small business tax tips that you can apply to help you maximize your tax refund. Auto repairs and mileage (1:20) -- Anyone in business has expenses relating to using a car. Unless your job is done from 100% cyberspace, you have to leave the house to meet with clients, network and pick up supplies. If your job is significantly sales oriented, this mileage can really add up. You can use a standard rate of 55.5 cents per business driven mile. That is not all though. If you use a newer vehicle, you can write off the additional depreciation related to your business expenses. Of course, if you use the car for both business and pleasure, you are only allowed to write off business miles. New business exemption (2:28) -- If you are a starting up a small business you are allowed to deduct up to $5000 for the first year that you are in business. This deduction is for things like supplies, utilities and repairs. This is for start ups only and only applies to the first year of your new business. You can either take the $5000 in a lump deduction, or you must deduct it in equal amounts over a period of 5 years. Bad Debts (3:39) -- If a customer stiffs you over a certain amount, you can claim it as bad debt and write it off. This bad debt deduction is only for products and is not for services. Interest (3:53) -- Most businesses do not start up without a little bit of financing. If you have a loan or credit card that you use, the interest on loans are completely tax deductible. Keep all your receipts in the event you get audited, so you can prove the charges were business related. Advertising and Promotions (4:54) -- Of course, this means big things like commercials, but it also means small things like business cards and stationary. If the item is used to promote your business, then it is tax deductible. The expenses of networking, like attending conferences and taking clients out to lunch are also deductible. Home Office Expense: Frequently failing to document the square footage of the home, creating a business-only environment, and document its business purpose is the most common issue 2. Vehicle Expense: mixing personal and business use of vehicles and not properly tracking milage is a large are of non-compliance 3. Insurance: Specially with health and life insurance, which have very special rules in order to be deductible.. in many cases these may NOT be deductible if rules are not followed 4. For any small business owner, tax compliance can be a huge source of anxiety. You may feel tempted to skip them but doing so would cause some very, serious issues. Don't let the stress of filing your small business taxes have you making mistakes, either. To help, we're going over some of the most common tax compliance mistakes so you can avoid them in this video. MISCLASSIFYING A HOBBY To start things off, if you have not yet generated enough income, the IRS may still classify the business you're starting as a "hobby." It's important to understand this because when starting a business you may be counting on certain tax deductions for things like supplies or even home office space. SEPARATING EXPENSES When you own a small business you'll need to separate personal and business expenses for the purposes of filing taxes. If you're not meticulous about record keeping, this process can really become difficult. For instance, you'll want to deduct for the mileage from the trip you took to the post office when mailing out packages to customers. Be mindful that the deductible mileage stops when you make a second stop to pick up your groceries. When it comes to these types of expenses, it may become impossible to accurately separate personal and business expenses if you're not tracking them day to day. You should have a separate credit card and bank account for your business. Consistently use the designated account and keep all of your business receipts and records separate. Also, consider paying yourself a salary instead of just drawing from your business earnings as needed. INSUFFICIENT RECORD KEEPING Good record keeping includes saving all of your receipts, tracking and categorizing all sales and all expenses, and logging business activities. It may be tempting to simply stash all your receipts in a box or store digital copies in a folder on your computer. If you wait until you're nearing tax time you'll be creating an unnecessary headache for yourself. Worse than that, you will probably find that you're rushed. This is how you can easily miss deductions or make other mistakes that you'll pay for later. DIY FILING ISSUES You may want to save money by preparing and filing your small business taxes yourself. There is business tax software to help with the process. But it's important to understand what you're missing by taking that less expensive route. Any competent tax professional or CPA should be able to ensure that you avoid all of these common filing mistakes for your small business taxes. When taking the work into your own hands you're much more likely to miss valuable deductions and perks simply because you're unaware that they exist or apply to your business. Hiring a professional has other major benefits as well. Tax preparation means recording an analyzing income and expenses to some extent. This is the start of the work that's necessary to more effectively run your business. MISSING APPLICABLE DEDUCTIONS There are so many ways to miss out on tax deductions for your small business. The answer depends on how the LLCs is taxed. If the LLC is a disregarded entity flowing to your individual return will loose control. Than if you don't have to file as an individual than no. LLC does not have to file (For Federal.. For State it depends on where the LLC was formed). LLC are typically taxed as either Partnerships or Corporations unless treated as a disregarded than you will have to file. If it is a Partnership you will need to file a 1065 in an annual basis. If it is a corporation you will need to follow the rules and file a tax return as well. LLC does not exist to the IRS, it simply lets the IRS know how to tax it. File tax #: Cooperation is a 1120S, 1120, Partnership is 1065, Disregarded Individual 1040.
