What is General Liability Insurance?
General Liability Insurance is something small businesses may need. Often it is requested by a customer (or the company hiring you as a contractor). General liability insurance is designed to cover any loss (damage) that may result from an accident caused by you while you are working in someone else's place of business. Proof of General Liability insurance is conveyed on an "Acord" form. This is a form that they insurance company will make. This is not a form that you get to fill-out. Your customer will want to be listed as a "Certificate Holder". And, they might also ask to be an "Additional Insured". Each Acord form is made individually for each requesting customer (your customer). The insurance premiums will vary widely depending on the type of business. The greater the risk, then the higher the premium. Business General liability insurance is NOT the same as Errors and Omissions insurance. People sometimes get these confused but they are very different things.

My name is Tim Gaspar with Gaspar Insurance Services. We insure small and mid-sized businesses and handle their insurance needs. Today I am going to talk a little bit about general liability insurance, what exactly it is, and how much you need as a business owner. Having general liability insurance is the absolute basis of any insurance. I would say that if you could only afford to have one insurance, I think for most businesses general liability would be the insurance they would get. It is the absolute foundation to having your business insurance in place. Essentially, general liability insurance is the protection you have in the event you're responsible, or your business is responsible for causing damage to a person or to property. And this can happen in a number of different ways. One of the most common is with a vehicle accident. Let's say your company trucks gets into an accident. You hit somebody and damage their car, and let's say they get injured. If they file a lawsuit against you, that's covered under your general liability insurance. Along the same lines, let's say you are manufacturing a product of some kind. Let's say for instance that you are a pistachio distributor. If you distribute pistachios and the people that eat them end up getting sick, let's say you get sued in a class action lawsuit for your product hurting somebody. That also falls under your general liability insurance. So as you can see, it can cover a few different scenarios that can be extremely important in protecting your business in the event that a lawsuit like this occurs. Now when it comes to how much general liability insurance you need, there are a couple of things that dictate exactly how much coverage you want to get. For most people, especially when you are first starting out in business, usually this is going to be dictated by your landlord or the vendors that you do business with. When you move into a new place, whether it be an office or retail store or warehouse, generally speaking, your landlord is going to ask for at least one million dollars per occurrence, and two million dollars aggregate just to get started. And what those limits mean is that any single lawsuit or claim that you file, you're going to have one million dollars in coverage for that single occurrence that happens. If you are unlucky enough to have two occurrences in a single year or more, the policy is going to cap out at the aggregate. Another key thing you want to look at in regards to how much insurance you get, is how much your vendors want you to have. Let's say you are a clothing distributor, if you do business with big clothing stores like Nordstrom's for instance, they might require you to four or five million dollars in general liability insurance because they want to make sure that they are protected in the event that something wrong happens with your product. So even if you are a small business, and let's say you don't have a whole lot of assets, you may have to get a lot of coverage just to make the people you do business with satisfied with the type of insurance you have. Now also, in regards to figuring out how much general liability insurance you should have, certainly the limit on your insurance should grow as your business grows. Most small business owners will say that the best plan is the most affordable one, but there are three main factors that can influence what you’ll pay when picking a new plan. The amount you pay toward employee premiums. The age and health needs of your group, which may affect out of pocket costs. And the type of plan you prefer. Let’s look at each of these in more detail. First, your premium share is the amount the business must pay toward employees’ premiums. Typically, the business must pay at least fifty percent of your employees’ monthly premiums under a small business health plan, though the percentage can vary by state or plan. You’re not generally required to contribute toward the monthly premiums of your employees’ dependents, but some employers do. A second factor that may influence your choice in a plan is the health of your group. How old are your employees? Do they see the doctor frequently? No qualifying employee will be refused insurance or charged more based on his or her medical condition or history, but these factors may still be important when choosing a plan. Understanding how health insurance impacts your employees and their families is important and your employees’ needs should be discussed when shopping for a plan. If your employees see the doctor frequently or use prescription drugs on a regular basis that may affect your choice of a plan. Choosing plans with higher deductibles and copayments may mean a lower monthly premium, but you’ll want to make sure you and your employees can afford that deductible in case you need medical care. Finally, the type of plan you choose can play a factor in your costs. HMO-style plans tend to have smaller networks of doctors and hospitals and so they may cost a bit less than some PPO-style plans that allow you more freedom to choose your doctors. You may also want to consider partially self-funded health plans. With a partially self-funded plan, you set aside a certain amount of money to pay for employee medical costs, but that money may be refunded to you at the end of the year if it’s not used. Work with a licensed health insurance agent to learn more about your coverage options and to get quotes that are tailored to your group’s coverage needs and budget.

All Up In Yo' Business: LLC or Liability Insurance
This video is in response to another great question I received from one of my viewers: If I am a sole-proprietor and have a $250,000 liability insurance policy, do I still need to form my business as an LLC? Or in other words, what's the best route to protect my personal liability? An LLC or liability insurance? Now, if you are a lawyer or have ever gone to law school, you will hopefully appreciate this answer. If not, then I am sorry that you can’t be in on the inside joke. But the answer to that question really is: “It Depends.” It depends on a few factors, including the industry that you are going into and whether or not there is a lot of risk of lawsuits and liability within that industry. It also depends on your tolerance for risk. If you are willing to take a higher risk and save a little bit of money and administrative work, then it might be worth it to go one way or the other. One of the primary purposes of forming a business as an LLC is to give yourself that liability protection, so if there is any liability to the business, you as a person and as an individual are protected from that liability. So, let’s pretend that you are operating as a sole proprietor and you haven’t formed an LLC, but you have this $250,000 liability insurance policy. If you do something in the course of your business that opens you up to liability and somebody sues you, then that insurance policy is hopefully going to cover any of your liability. But, if you do something really bad and you are liable for over $250,000 worth of damages, then you will kind of be screwed since your insurance policy is only going to cover you for up to that amount. In this instance, you will be personally liable for anything on top of that amount. If, on the other hand, you formed an LLC, then it will hopefully be only the assets of the business that are at risk for that liability your personal assets will most likely be protected. So unfortunately, I can’t give a definite answer to this question since it depends on multiple factors and on your own tolerance for risk. If the likelihood of you being involved in any type of lawsuit due to your business industry is low (ie., if it’s just not very common businesses in your industry to be involved in any lawsuits), then it might be worth it to just save the money and get that insurance policy and not deal with the hassle of forming and maintaining an LLC. But, if you really want to cover your a**, then the best thing to do is to form that LLC and get that insurance policy.
