BOOK REVIEW ROME I REGULATION Pocket Commentary Edited by Franco Ferrari SELLIER EUROPEAN LAW PUBLISHERS (SELP) NYU: Center for Transnational Litigation, Arbitration and Commercial Law ISBN: 978 3 86653 241 0 www.sellier.de A USEFUL FIRST REFERENCE TO THE ROME 1 REGULATION ON CONTRACTUAL OBLIGATIONS -- BY AN EXPERT TEAM OF CONTRIBUTORS An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers For students (primarily graduates and undergraduates) and practitioners professionally involved in European Union law in general -- and in the area of conflict of laws in particular -- this handy pocket-sized but comprehensive and detailed text is quite a find. It is the second volume in the increasingly well known ‘selp’ series of Pocket Commentaries published by Sellier European Law Publishers. Bearing in mind the more than occasional abstruseness of European Union regulations, this is an excellent publishing initiative which is very handy for practitioners, especially international lawyers, to know about. This particular volume offers concise yet detailed and instructive commentary specifically on the Rome 1 Regulation. The twelve learned contributors, including the editor Franco Ferrari, are either expert practitioners with well-known international law firms, (Baker McKenzie for example), or distinguished academics from leading universities. Franco Ferrari, for instance, is Professor of Law and Director of the Center for Transnational Litigation, Arbitration and Commercial Law at New York University School of Law – and has also served as a Legal Officer at the United Nations Office of Legal Affairs, International Trade Law Branch. Similar to other books in this series, this commentary is meant to provide ‘a first reference’ to a particular instrument; in this case, Rome 1. Just to get technical, Rome 1 is the Regulation (EC) No593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations. Rome 1, in other words, is about contracts. Aiming at achieving a desirable level of predictability and legal certainty for the parties to any given transaction, it sets forth (as the editor explains) ‘a set of uniform private international law rules for (most of) the member states of the EU.’ One can see the overall objective here. The Regulation is part of a general movement toward the harmonization of law across Europe -- and is particularly applicable to transactions which are linked, not just to one country, but to two or more within the European Union. For those engaged in the study, or application of European Law, this book with its thorough and extensive footnoting (containing a mine of references) is a useful acquisition. It does presuppose some familiarity, in fact considerable knowledge, of this particular aspect of European law on the part of the reader and is therefore perfect for researchers or practitioners seeking an enriched, in-depth and certainly authoritative examination of the Rome 1 Regulation. The publication date is cited as at 2015.

Logically structured in three parts and written in accessible English, this important text does what it says in the title, guiding you through the complexities of The European Private International Law of Obligations. To cite only one issue among thousands: which countrys laws should be applied in any given cross-border relationship or transaction and in what circumstances? For instance, in the case of an English worker employed by a Dutch company on an oil rig in Nigerian territorial waters injured by the negligence of a fellow employee, which system of law is applicable? Well, you see the problem -- and the judgments in this case in particular have been much criticized, which is why one of the books more intriguing chapters is entitled The Country Whose Law is to be Applied. The books original title for its first two editions was: The European Contracts Convention: The Rome Convention on the Law Applicable to Contracts. As the Preface explains, the new title was made necessary for this new third edition by the development of case law on the Convention, both at the national level and within the Court of Justice. The authors were careful to prepare the new edition only after the conversion of the Rome Convention into a regulation and the entry into force of the parallel regulation of the law applicable to non-contractual obligations. The new title better describes the wider compass of the work, which will certainly help you interpret, apply and advise upon the Rome I and Rome II Regulations. Expert commentary is provided throughout on the scope, principles and application of the rules of private international law governing the construction of contracts. Also covered are the new rules governing torts, including product liability, liability for breach of competition rules, environmental damage, unjust enrichment, negtiotorum gestio and culpa in contrahendo. Consumer contracts, employment contracts, mandatory rules, ordre publicand more are considered. The distinction between establishment and services is based on the idea that establishment is more permanent whereas services are more temporary in nature. Establishment mainly falls under Art. 49 with 49(1) allowing for primary and secondary establishment and (2) prohibiting unequal or discriminatory treatment. The law in this area is directly effective as per Reyners [1974]. Equivalent qualifications across member states are interpreted broadly as per Heylens [1987] and also Directive 2005/36 Meanwhile article 49(2) has been broadened beyond discrimination to include any unjustified restriction on the freedom of establishment. The main case in this are is Gebhard [1995] that allows for restrictions only if they meet four criteria: 1) Non-discriminatory 2) Justified 3) Needed to secure an objective 4) Don't go beyond what is necessary to achieve that objective A national can rely on Art. 49 with respect to their own member state only when they have exercised the freedom of movement themselves as per Knoors [1979] Article 54 states companies should be treated in the same way as individuals and although company law can vary from state to state the ECJ has placed a lot of focus on achieving the overall objective of freedom of establishment as seen in Centros [1999] and Überseering [2002]. However once a company is established in a Member State they are then subject to that country's rules as regards incorporation etc. as per Daily Mail [1988] and Cartesio [2008] The liberalisation provided by Art. 54 means that it can be difficult to crack down on tax avoidance as seen in Cadbury Schweppes [2006]. Freedom of services is based on the temporary nature of the work rather than the infrastructure or, as per Commission v Portugal [2010], the period of time. Art. 57 loosely defines services and 58 excludes other services that are covered in other parts of the treaty. Art. 56 also has direct effect as per Van Binsbergen [1974]. Similarly there also has to be an inter-state element as seen in Deliège [2000] Also covered is the freedom to receive services; Luisi & Carbone [1984] The service does have to be provided for remuneration and this line can become blurred in relation to certain healthcare systems that are a hybrid between user and government payments Some controversial services such as abortion, gambling and marijuana can still be considered services (Grogan [1991]) but can be subject to national rules that provide a proportional and non-discriminatory restriction (Zenatti [1999]). Taking a broad definition it is even possible that certain social benefits may also fall within the definition; Cowan [1989]. Art. 62 allows for restrictions on policy, security and health grounds. Beyond this Van Binsbergen [1974] sets out the conditions for any restriction imposed by a Member State: 1) Pursuit of a legitimate public interest 2) Applied without discrimination 3) Proportionate 4) Respects fundamental rights (Carpenter [2002]) This freedom can be controversial as it allows greater liberalisation in the labour market at the expense of employee rights. This came to a head in Laval [2007] although this judgment has been tempered somewhat by the Rome I Regulation. Restrictions on tax grounds can be allowed to prevent fraud but not for other, broader reasons; Danner [2002]. Non-discriminatory restrictions can also be caught if they are a hinderance to the freedom of services (Alpine Investments [1995]) and Gebhard [1995] also applies within this context. The Bolkenstein Directive sought to achieve greater harmonisation by focusing on the country of origin but after protest this was watered down and so only mainly deals with a range of procedural and administrative issues.

It is 6 km (4 mi) NW of Velletri and about 30 km (18 mi) southeast of Rome. The town's name derives from the Latin nemus Aricinum, or "grove of Ariccia": the latter is a small town a quarter of the way around the lake. In antiquity the area had no town, but the grove was the site of one of the most famous of Roman cults and temples: that of Diana Nemorensis, a study of which served as the seed for Sir James Frazer's seminal work on the anthropology of religion, The Golden Bough. In 1514 Marcantonio I Colonna gave to Nemi the "Statuti e Capituli del Castello di Nemi", the first city statute with rules and regulations to observe.Later on, possibly in connection with this cult (nothing substantial is known of the matter), Caligula built several very large and costly luxury barges for use on the lake. One ship was a shrine dedicated to ceremonies for the Egyptian Isis cult or the cult of Diana Nemorensis, designed to be towed, and the other was a pleasure boat with buildings on it. After Caligula's overthrow, the boats were scuttled. The ships were rediscovered during the Renaissance, when architect Leon Battista Alberti is reported to have attempted to raise the ships by roping them to buoyant barrels. While ingenious, this method proved unsuccessful, because of extensive rotting. The boats were finally salvaged from 1929 to 1932 under orders of Mussolini. This was just one of many attempts to relate himself to the Roman Emperors of the past. The ships were exposed by lowering the lake level using underground canals that were dug by the ancient Romans. The excavation was led by Guido Ucelli and was reported in Le Nave di Nemi by Guido Ucelli (Rome, 1950). They were destroyed by fire on 31 May 1944, it is disputed whether this was done by defeated German forces retreating from Italy at the end of World War II or accidentally by squatters taking refuge in the museum building. Surviving remnants from the excavations as well as replicas are now displayed in the Museo Nazionale Romano at the Palazzo Massimo in Rome. The ship hulls survive today at Museo delle Navi Romane, Nemi.

Kean Wong: Italy is vowing to come down hard on immigration laws, making illegal immigration a criminal offence and reducing the number of Immigrant camps in the capital. Here's more. Rome's new mayor pledged to expel 20,000 immigrant criminals and knock down illegal camps put up by mostly eastern European Roma people. [Gianni Alemanno, Rome's Mayor]: "We have to face the problem of Roma camps with a tougher and more effective law that can allow us to expel and repatriate people more rigourously." More than 500,000 Romanians are estimated to live in Italy, a number which Rome says jumped dramatically over the past year. Crime and immigration were a top issue in the run-up to last month's parliamentary election, which Prime Minister Berlusconi overwhelmingly won. [Silvio Berlusconi, Prime Minister]: "We are working on a security bill that will be very strict but respectful of all the European legislation, we are aware that a just law means that we need to work at the integration of non Italian citizens but at the same time we need to reinforce bilateral cooperation with countries such as Libya and Romania." Thousands of illegal immigrants cross over from the shores of Libya to southern Italy every year, usually risking their lives on rough seas in inadequate boats.

"We Filipinos are not so very much afraid because we are all good citizens here in Italy", explained Nena Ty Gunda, a 54-year-old Filipino who runs a food kiosk at the open-air market. "We have all work and we work honestly so that is not a big problem." Soon-Sub Chun, an immigrant from North Korea, felt the same. Maarten van der Weijden is an Olympic swimming champion and has won gold for the 10 kilometers open water event at the Olympics in Beijing 2008. He also survived cancer and was forced to take two years out to survive the disease. At one stage he was not expected to survive. Contrary to Lance Armstrong, the cancer surviving Tour de France biker, Van der Weijden doesn't agree it is only positive thinking and lot's of sports that has saved him. 'I even think it's dangerous because it implies that if you are not a positive thinker all the time you lose.' says Van der Weijden. GRUBB (Gypsy Roma Urban Balkan Beats) are a collective of young Roma (14-18) and international artists. They offer a modern approach to the traditional music of their Romani roots, adding dance, magic and photography to create an exceptional and unforgettable theatrical experience. Combining a musical blend of contemporary hip hop, dance and pop with the richly influenced and historic music already synonymous with their ancestors, GRUBB are bringing Roma music storming into the 21st century. The music, however, is only the backdrop to an immersive and moving story of their lives that varies from the universal themes of first loves and friendships to the struggles that are unique to the Romani people. GRUBB has grown from music workshops created by RPOINT (an NGO working to give young Roma access to education) led by Serge Denoncourt. It is the first performance of it's kind, performed by its creators, a group whose voices have never before been heard. After an internationally-acclaimed 8-day performance at the Montreal Jazz Festival in June and a highly anticipated performance at BITEF 2011, GRUBB will bring to [email protected] their message to the world. Oni nude moderan pristup tradicionalnoj muzici svojih Romskih korena, koristeći muziku, magiju i fotografiju pri stvaranju izuzetnog i nezaboravnog pozorišnog iskustva. Kombinujući savremeni hip-hop, ples i pop sa tradicionalnom muzikom svojih predaka obogaćenom raznim uticajima, GRUBB gromoglasno donosi romsku muziku u 21. vek. Međutim, muzika je samo pozadina dirljive priče njihovih života sa raznim temama od onih univerzalnih o prvim ljubavima i prijateljstvima, do borbi i nedaća, karakterističnih za romski narod. I grew up in Roskovec until I finished the 8th grade and then immigrated to Italy on my own to look for work opportunities. I ended up being taken in by a school for boys without families, "Fondazione il Faro", in Rome. There, they tried to integrate us into the community by teaching us the Italian language as well as giving us technical skills like making pizza, cutting hair, carpentry and computer programming. After a year at the school, I found my first job as a waiter in a vegetarian restaurant. The work was challenging and I loved it. I waited tables for the next six years, working at renowned Roman restaurants learning a great deal about Italian food and wine in the process. In 2004, I met my wife, Kaleigh, a Montana native, who was a student traveling and studying in Rome. We were married and later had a beautiful baby girl, Fiona. In 2006, we moved back to the U.S. to Montana, where I continued looking for positions as a waiter, but instead was offered a job in the kitchen at "La Provence" Restaurant, owned by Chef Marc Guizol. At La Provence, a new fire started inside me to become a Chef. I had worked as a waiter for 6 years without realizing that my true calling was in the kitchen. I decided to attend the New England Culinary Institute (www.neci.edu) in Vermont, where I earned a degree in Culinary Arts. The school was 2 years straight, hands on with small classes only 7 students per teacher. In 2008, I did my first internship with Chef David Kinch at Manresa, a 2 star Michelin-rated restaurant, (www.manresarestaurant.com) in Los Gatos, California. I spent the majority of my internship working as the assistant pastry chef and learned an incredible amount about the finer aspects of baking and pastries. After Culinary School we moved to Chicago for 1 year. In Chicago, I worked for the Capital Grille, Intercontinental Hotel, and Cafe Bernard. My wife Kaleigh took wine classes to become a sommelier. We never were able to call Chicago our home and decided to move back to Montana and open up our own restaurant, and with lots of hard work we did it. 6 years later we have two Mediterranean restaurants, work 70 plus hours a week and have found great success, having been featured in Food Network Magazine, PBS and the Wall Street Journal. We love what we do but are finding that we are missing all the important things... we work on holidays and at night, we miss concerts and school meetings and soccer games. Fiona just turned 9 and suddenly it hit us that we only have so much time with our kids...another 8 years and she's gone to live her own life... The world is in the middle of a nearly unprecedented economic crisis, one which went to the very heart of the global capitalist system. Michel Camdessus Former Managing Director, IMF This crisis has blown up really at the center of the system, Wall Street, and has immediately had universal repercussions. While the Mexican crisis of 1994, 1995, while the Asian crisis of 1997 and the following years have been more localized in parts of the world with less global repercussions than this one. Michel Camdessus was managing director of the International Monetary Fund for 13 years. An economic adviser for the Pontifical Council of Justice and Peace, he says the root of the problem is greed and a lack of ethics. Michel Camdessus Former Managing Director, IMF What has taken place also is a kind of ethical global problem. During years and years, we have allowed all the sound warnings which were given since Adam Smith to the financial actors, namely to moderate their financial appetites, to care about their community, to care about their neighbors, all these principles have been forgotten. We must reestablish a kind of global ethical system which is just missing. And for that, all institutions, states, cultural leaders, churches have a role to play. In addition to ethical reforms, Camdessus says governments need to put in a new system of regulations and financial architecture to monitor the markets, to prevent this sort of problem from ever repeating itself. He also says that individuals can do their part as well, to help fight the financial and environmental crises. He sees the two problems as linked together. Well, all of that means that all of us must rethink our consumption model. We must all be more conscious that in the years to come we will have more responsibilities for supporting the poorest countries in the world. Professor Gunilla Bradley shows us that we now have a new chance to explore the human side of societal change and take advantage of the technology to shape a good and balanced life. Watch Professor Bradley as she informs us how to us this opportunity for redesigning society towards a good society for all. Gunilla Bradley (GB) is Professor Emerita in Informatics at Royal Institute of Technology (KTH) – School of ICT in Stockholm. GB is originally a psychologist and has a broad background in the social and behavioral sciences. Her research concerns the interplay between Information and Communication Technology (ICT), Human Beings, and Society – Social Informatics. Her cross disciplinary research groups were first hosted by Stockholm University for twenty years. She has then been a visiting professor at Stanford University two years and professor of Technology and Social Change at the Royal Institute of Technology. 1997 – 2001 she served as professor in Informatics at Umeå University and Mid Sweden University. In 1997 GB received the prestigious Namur Award from IFIP for her pioneering research to increase the social awareness of the impact of ICT. GB has authored thirteen books and contributed extensively in international scientific journals and the popular science press. Her latest book Social and Community Informatics – Humans on the Net (Routledge 2006) is widely used in both ICT related disciplines and in the social sciences. In 2008 GB was invited as guest professor in Salzburg. She initiated and chaired the annual IADIS (International Association for Developing the Information Society, NGO) conference on “ICT, Society and Humans” that took place in 2011 in Rome and in 2012 in Lisbon. In 2010 she was honored by a “Fest Symposium” at the newly inaugurated Linnaeus University in Sweden and a “Festschrift” (Eds. Haftor & Mirijamdotter, 2011). Born in Bologna in 1947, he graduated in Law from the University of Rome. He continued his studies at the Columbia University in New York and specialized in International Commercial Law. He started his career working with the Chiomenti law firm in Rome and then joined Bergreen & Bergreen in New York. Between 1973 and 1977, he worked as Assistant to Enzo Ferrari and Team Manager of the Maranello racing team, winning two Formula 1 world driver's championships with Niki Lauda in 1975 and 1977. Between 1977 and 1981, he was Senior Vice President of External Relations of the Fiat Group. Between 1981 and 1983, he served as Chief Executive Officer of Itedi S.p.A., the holding company for all Fiat Group publishing activities, including the daily newspaper La Stampa. From 1984 to 1986, he was Chief Executive Officer of Cinzano International S.p.A. in Geneve and in charge of organizing Azzurra, the first Italian yacht to compete in the America's Cup. From 1986 to 1990, he was General Director of the Organizing Committee of the 1990 Italian World Cup Football Championship. From 1990 to 1991, he was Chief Executive Officer of RCS Video and a Member of the Board of Directors of TF1, the most important French television channel. Mr. Montezemolo is Chairman of Ferrari S.p.A. since 1991 and has been also its Chief Executive Officer until 2006. He served as both Chairman and Chief Executive Officer of Maserati S.p.A. from 1997 to 2005 and President of Confindustria and of the Bologna International Trade Fair from 2004 to 2008. He has been Chairman of Fiat S.p.A. and President of LUISS University from 2004 to 2010. He is Chairman and one of the main shareholders of NTV (Nuovo Trasporto Viaggiatori), first Italian private high-speed railway company and since July 2009 he is President of Telethon. In 2009 he founded the Association Italia Futura, established to promote civil and political debate on the future of the Italian country, with the help of numerous members of the Italian civil society. He served as President of the Industrialists of the Province of Modena for 6 years, until June 2002, and President of FIEG — Federazione Italiana Editori Giornali (Italian Newspaper Publishers Association) until July 2004. He is also a Cavaliere del Lavoro and in 2008 he was awarded the Legion d'Honneur by the President of the French Republic. In 2001 he was elected "man of the year" by "The Automobile", the most important US automobile magazine, and in 2002 by "Autocar", the prestigious English magazine. He was nominated by "Financial Times" as one of the fifty best managers in the world in 2003, 2004 and 2005. He was awarded five honorary degrees: in Mechanical Engineering by the University of Modena, in Combined Business Management by the CUOA Foundation of Vicenza, in Business Management by the University of Genova, in Industrial Design by the Politecnico of Milano and in Physics of Materials by SISSA (International School for Advanced Studies) of Trieste. He is a Member of the Board of Directors of Fiat SpA, La Stampa, the luxury French Group PPR (Pinault/Printemps Redoute) and Tod's. He is on the General Council and Executive Committee of Assonime. He is a Member of the International Advisory Board of Citi Inc. He was the founder of Charme, a financial-entrepreneurial fund which was used in 2003 to acquire Poltrona Frau, one of the most renowned Italian companies active in the furniture field of which he is also a Member of the Board of Directors, then followed by the acquisition of the Cassina, Cappeilini and Thonet brands and in 2004 by Ballantyne, the historic international cashmere brand.
